When it comes to product liability, as discussed last month, there are a number of parties that can be involved in the event of a claim. Product Liability claims arise when a product sold to a consumer causes injury and is considered defective or unreasonably dangerous. The very basic understanding of product liability rests in definition and the law. Continue reading →
First, let’s be clear – this is only a SMALL sampling of simple questions agents and underwriters fail to ask! There are dozens of simple, common sense questions that are often skipped – why remains a mystery.
Second, this article does not provide every answer or option available for each of these questions. This is not intended as a text book, the point of this short article is to raise your awareness of the need to ask questions, even or especially those that may seem basic. Because if you don’t ask, the lawyers will (and juries will be very interested in the simplicity of the questions). Continue reading →
The New Year brings yet additional IRS reporting responsibilities for some employers under the Affordable Care Act (ACA). Many employers will now need to file a range of reporting forms reflecting compliance with the health care reform’s “shared responsibility” mandate to provide affordable health coverage to their employees. However, many are still uncertain about the requirements to provide employees with these new ACA disclosures. Continue reading →
Every year, we do it on the same day at the same time. The instant the calendar changes from the old year to the new one, we convince ourselves that this year will be different. We’re going to do everything we didn’t do in the past. It’s a predictable ritual; it’s become part of our DNA.
Good faith efforts rarely work. “Stuff” gets in our way and throws us off course. The big challenge is ending the year with the same drive and resolve with which we started it. Here are seven actions that can help: Continue reading →
The next wave of hobby drones will be wrapped in boxes underneath Christmas trees before they fill the skies. If industry sales projections come true, the holiday season will put tens of thousands of relative novices at the controls of small unmanned aerial vehicles in densely populated cities and suburbs. All that amateurish swooping over houses and cars, spooking pets and dodging humans, will invariably lead to cracked windows and more than a few bloody injuries. Continue reading →
On Oct. 1, 2015, many of the insurance industry’s clients took on a lot more risk, and may not even know it. The Payment Card Industry, PCI, which is the self-regulating organization that oversees everyone that accepts or issues payment cards, set the date of Oct. 1, for point-of-sale machines to begin accepting “chip cards.”

It is estimated that the average American will spend at least $700 on gifts this holiday season. For the commercial industry that is good news. From importers, manufactures, distributors, wholesalers to retail stores, products have a long road to travel before they end up in American homes for the holidays. Product liability insurance plays a huge role in all entities that create products because defects can rest with any party in the products chain of distribution. Continue reading →
The weather outside is frightful… ok not quite here in Las Vegas, but it is chilly. The holidays are around the corner and, with many Americans already holiday shopping, the busiest retail season has begun. Yes I hate to admit it, I am one of them. While consumers are more driven to buy early, save money, and get the deal before it is too late, one should consider safety when it comes to holiday shopping. If you venture out on black Friday to score some major deals like me, be sure to take precautions when “stuffing” the car. Continue reading →
